General terms & conditions of trade & delivery.



  1. Scope

These General Terms and Conditions apply exclusively to all current and future purchases, orders, and shipping agreements between consumers and LECON PRODUKTE Vertriebs GmbH, even if no explicit reference is made to them. They form an integral part of all transactions between Lecon and end consumers. All information and data in our product descriptions and advertising materials are subject to change. Errors excepted. All offers from Lecon are non-binding unless explicitly marked as binding.


  1. Offers

Unless otherwise agreed, an offer from Lecon becomes invalid if it is not accepted by the consumer within one month. Orders must correspond to the specified quantities. If the ordered quantities differ from those offered, the prices will be adjusted accordingly.


  1. Orders

Orders must be placed using the exact registered company name and billing address. Lecon is only obligated to supply customers if it has confirmed the order in writing or electronically and if all order details are included. Such an order confirmation must be sent to the customer by Lecon within a maximum of two weeks from the date of receipt of the order.

Orders are only considered accepted upon transmission of an order confirmation or fulfillment by Lecon. The price and product information stated in the order confirmation applies. Any objections to prices, quantities, or specifications stated in the order confirmation must be submitted in writing within two days of receipt of the order confirmation. After this period, the details contained in the order confirmation are considered expressly accepted. Oral and written additions, amendments, or supplementary agreements require written confirmation from Lecon.


  1. Prices

The current price list, as provided to the consumer upon request, applies in EURO including VAT, transport, and transport insurance costs. Price lists are subject to change without notice and are not liable for errors or misprints. Depending on the destination country, additional customs duties and taxes may be payable by the customer and will be collected by the courier upon delivery. Offers are non-binding and subject to change without notice. Product weights are subject to production limitations; weight variations are possible. The total weight indicated on the individual sales unit applies. Additional charges or price reductions resulting from subsequent changes or requests by the customer will be invoiced separately.


  1. Payment

Upon order confirmation, the customer shall pay Lecon the full order amount in advance. All domestic and international expenses incurred in connection with the chosen payment method shall be borne by the customer. Representatives are not authorized to collect payments. Any changes to the payment terms require the express written consent of Lecon.


  1. Delivery

After Lecon receives payment, the ordered goods will be delivered in the manner and within the timeframe specified in the order confirmation. The stated delivery dates are not guaranteed. Partial deliveries are permitted for orders with multiple items. Delivery is generally ex works Vienna by the transport company preferred by the customer or, if the customer has not specified a preferred transport company, by a suitable transport company at the recipient's risk. Each delivery must be inspected immediately for quality and completeness. To preserve insurance claims, the recipient must report any damage in transit to the transport company immediately upon receipt of the delivery and to Lecon by registered letter within 3 days of delivery. After this period, the delivered goods are considered accepted. For evidentiary purposes, any defects must be noted on the waybill upon receipt of the shipment before acceptance. The customer bears the risk of any official or administrative restrictions regarding the permissibility of importing and placing the products on the market. The customer is obligated to obtain any necessary foreign exchange or other administrative permits at their own expense. Partial deliveries are permitted for orders with multiple items. If the goods are not accepted, storage fees of 3% of the goods' value per month will be charged.

Please note that in certain areas defined as "residential areas," express courier services, in particular, may leave deliveries at the recipient's doorstep if the recipient is not present.

Lecon assumes no liability for shipments that cannot be delivered due to incorrect or incomplete address information provided by the customer.

Lecon has met an agreed deadline if the ordered goods have been dispatched within the agreed delivery time or have been collected by the customer or a third party on their behalf. Acceptance of the goods by the customer constitutes approval of the delivery date. Lecon is not liable for any delay in delivery if the delay is due to reasons beyond its control, in particular force majeure, mobilization, war, war-like events or other unrest, transport delays, strikes or other transport disruptions. The aforementioned events release Lecon from its obligation to deliver or perform on time for the duration of the event.


  1. Warranty

All products are inspected by us before shipment. Complaints regarding deliveries must be made by registered letter within 8 days of receipt of the goods. For latent defects, complaints must be made within 14 days, but immediately upon discovery of the defect.

The return of defective goods requires the express prior consent of Lecon and is at the customer's expense and risk. The original certificate of origin and a copy of the delivery note must be included with the return shipment. In the case of a justified and timely complaint, the defective product will be partially or completely replaced with flawless, identical, or similar goods. Lecon only replaces goods that it has delivered.

To preserve insurance claims, complaints regarding transport damage and visible defects must be reported to the transport company immediately upon receipt of the delivery and to Lecon within 3 days of delivery.

For complaints regarding damage that is visible upon delivery or should have been visible at the time of delivery, we can only accept returns of products with unbroken packaging and seals within 8 days. Warranty claims are excluded in cases of atypical product use and damage resulting from mechanical impact. Lecon is unable to provide a warranty if repairs are carried out by third parties.

Lecon is not liable for defects resulting from the execution of explicit instructions by the customer. Quality and material properties can only be guaranteed in accordance with the warranties of our suppliers. Instructions regarding shelf life and storage must be strictly observed. We assume no liability for improper handling or storage of products after receipt, or for damage resulting from external influences. Further claims against Lecon are excluded. Lecon's liability is limited to the invoice amount. Lecon is not liable for consequential damages.

Lecon is not liable for consequential damages. The buyer's warranty claim ends at the latest upon resale of the products and is only transferable if the buyer is a reseller authorized by Lecon. Further claims against Lecon are excluded.


  1. Liability

Lecon is liable for damages only if intent or gross negligence on its part can be proven. Any further liability is excluded. Lecon's liability is limited to the invoice amount. Lecon is liable for consequential damages only in cases of intent or gross negligence. Liability for property damage under the Product Liability Act is excluded for all companies involved in the manufacture and distribution of the ordered product, unless an end consumer is harmed.


  1. Final Provisions

All agreements are governed by the laws of the Republic of Austria. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. For legal disputes and all claims arising from business relationships with merchants, the exclusive jurisdiction of the competent court in Vienna is agreed upon. Should any part of these General Terms and Conditions of Sale and Delivery be invalid, this shall not affect the validity of the remaining provisions. An invalid provision shall be deemed replaced by a valid provision that most closely approximates the economic purpose of the invalid provision. Any agreements deviating from these terms and conditions are only valid if they are in writing and duly signed by an authorized representative of Lecon.
